Terms & Conditions


1. Applicable laws
: A/The passenger booking and paying for services provided by Simpatico Tours Inc. acknowledges that he/she accepts and is bound to the terms and conditions as printed in this brochure. The terms and conditions of this of this brochure cannot be waived or varied by any person other than an authorized employee or representative of Simpatico Tours Inc. B/The purchase of any product in this brochure consists of a consensual agreement that is complete and represents an entire agreement between the passenger(s), travel agency and Simpatico Tours.

2. Prices: All prices specified in this brochure are in Canadian dollars and based on a per person occupancy. Rates are valid for the periods indicated in this brochure for each tour, hotel, villa, cruise or excursion, etc. All prices indicated in this brochure do not include the government Airport Improvement Tax or any other taxes implemented by the government. All rates are based on a currency exchange and taxes in effect at the time of brochure publication and all prices are therefore subject to change in case of fluctuations of the above.

3. Not included: Entrance fees are not included in any tour or excursion in this brochure unless specifically stipulated on the tour page. All entrance fees can be purchased and paid locally. Also not included are the airport taxes, passport, immigration and visa fees, porterage, gratuities for guides, hotel, cruise staff, or any other gratuities, excess baggage charges, laundry, beverages, meals (unless otherwise stipulated), optional excursions and any other items or charges not listed as being included. All incidentals such as phone charges and room service must be paid by the client directly at the hotel upon checkout.

4. Deposit, Confirmation and Final Payment: A $ 250.00 deposit per person is required at the time of booking, except for villas, castles and apartments the deposit is 400.00 per person . This deposit is to be received within the 7 days of confirmation. All reservations are subject to availability and are not considered confirmed until written confirmation has been provided to the travel agency. Deposits are fully refundable if confirmation cannot be made by Simpatico Tours Inc. Simpatico Tours Inc. reserves the right to cancel a booking without notice and impose a cancellation charge, as per clause no. 7, if deposit payment is not received within the specified period. Final payment is due 45 days prior to the travel date except for villas, castles and apartments the balance is due 60 days before departure. If the reservation is made within the 45 days, the final payment is due immediately. Simpatico Tours Inc. still reserves the right to cancel a booking without notice and impose a cancellation charge, as per clause no. 7, if the final payment is not received within the above specified period. All travel documents will only be released to the travel agency when the invoice is paid in full. Once the travel agency has received the documents, it is up to the travel agency to insure that all names and booking information on airline tickets, tours, hotels coupons, cruise, villa coupons or train coupons are accurate.

5. Credit Cards Payments: A customer who has purchased a product from the Simpatico Tours Inc. brochure is also authorizing the use of his/her credit card if the customer is paying his/her deposit or his/her final payment with the credit card. Agents may fax a Universal Credit Card form, validated with agency plates. In the event that the cardholder is unable to sign the form, signature on file is acceptable under travel agent’s responsibility. A verbal contract between the client and the agency to use the credit card is sufficient but we strongly suggest that the agency get a signed consent or a signed credit card slip from the cardholder in the event of a future contestation.

6 Revisions and/or Changes: Changes made to an existing booking are subject to the following penalties: More than 30 days prior to departure $200 per person; 30 to 15 days prior to departure $400 per person; and 14 days prior to departure is considered a total cancellation and is 100% not refundable, as per clause 7.

7. Cancellations: For tours/excursions, flights, hotels, transfers and cruises the following conditions and cancellation charges will be applied as follows:
Up to 45 days prior to commencement of services $250 per person: 44 – 22 days prior to commencement of services: 50% of total cost per person; 21 – 0 days prior to commencement of services: 100% of total cost per person. For villas, castles and apartments 60 days before departure $400.00 per person. 59- 0 days prior to departure 100% non refundable.
For Car rentals cancellation charges will apply as follows: Up to 7 days prior to the commencement of services: $75 for the car rental 7 – 0 days prior to the commencement of services: $150 for the car rental.

8. Insurance: Simpatico Tours Inc. highly recommends that consumers protect their investment and purchase insurance through their travel agent at the time of booking.

9. Flights, Carriers, Transportation: A/All flight times, flight itineraries and carriers are subject to change without notice. We strongly recommend that clients contact the airline within 24 hours of departure to confirm departure time. Flight check-in opens three hours before departure. Simpatico Tours Inc. recommends that clients check in between 3 hours before. Simpatico Tours Inc. cannot be held responsible if you miss your flight or your cruise or if you are denied boarding on a flight or cruise. Carriage and services performed and tickets issued are subject to rules relating to liability of the Warsaw Convention and the terms and conditions herein.
B/Cruise itineraries are subject to change without notice. Mechanical problems, weather or port conditions may require changes or cancellations to a cruise or to a port of call. In this case Simpatico Tours Inc. cannot be held responsible for any loss or expenses due to such changes or abandonment. If the cruise is withdrawn before a sailing date, clients are entitled to a refund of the amount that was received for that cruise and nothing more. Cruise embarkation begins
3 – 4 hours prior to sailing time. Passengers are responsible to be on board no later than 2 hours before the scheduled sailing time.

10. Connecting Flights: Passengers connecting with the tour operators’ flight(s) are strongly advised to allow ample time, a 3-hour minimum connection. Simpatico Tours Inc. does not accept any responsibility for additional charges incurred for airfares or any other expenses, as a result of a misconnection due to an airline change in schedule, strike, delays, changes in contracts between airlines, cancellations or any irregular airline operations. The customer cannot request a refund or money back from Simpatico Tours Inc. for any airline, cruise, tour, villa, excursion, hotel portion or coupon for services not used. In the case where the customer purchased transfers from Simpatico Tours Inc., but unfortunately the flight was delayed or cancelled or any other means of transportation impeded the customer to arrive at the scheduled transfer time, the transfers will be forfeited and Simpatico Tours Inc. cannot be held responsible nor can we replace the transfers at another time. The consumer will then reschedule and repay for new transfers.

11. Validity of Documents: Any changes made to airline tickets or any travel documents supplied by Simpatico Tours Inc. are subject to penalties. Please refer to Rule and Condition no. 7. All unused or partially used airline portions, hotel portions, excursions, tours, cruise or any of Simpatico Tours Inc. products are not refundable.

12. Luggage: Weight restrictions may vary between airlines so please ask your travel agent to verify the up-to-date information with the carrier you are reserved with. Please note that on a tour only one piece of luggage is allowed and it is the clients’ responsibility to ensure that their luggage goes on board the motor coach. All luggage or personal belongings remain at the owners risk throughout the entire trip (airline, tour, cruise, hotel, etc.). Simpatico Tours Inc. cannot be held responsible for luggage or belongings or money that is lost, misplaced, mishandled or stolen. Simpatico Tours Inc. recommends baggage insurance.

13. Consumer Notice: All travellers should be aware that differences in certain living standards and practices may exist outside Canada: provisions of utilities such as water, electricity etc.: accommodations, foods, quality of water. Simpatico Tours Inc. cannot be held responsible for any loss, damage, sickness or injury resulting from different standards of living.

14. Accommodations: Whatever the category of hotel, the room is a standard room unless otherwise stated. Special requests (suites, adjoining rooms, views, etc.) can be made, but not be guaranteed by Simpatico Tours Inc. Descriptions apply to twin rooms and facilities may vary for other room types. Simpatico Tours Inc. reserves the right to substitute hotels of equal or better category if necessary to ensure client satisfaction. Supplements will apply for certain periods (Fairs, Carnivals, Holidays, etc.) and for certain amenities (air-conditioning, etc.). All information regarding hotel facilities has been taken from the Official Hotel Directory or directly from the hotel. Simpatico Tours Inc. is not responsible for inaccuracies. All prices shown are per person per night and in Canadian dollars unless otherwise specified.

15. Modification or Substitution by Simpatico Tours Inc.: We reserve the right, at any time, at our own discretion, to substitute a carrier, sightseeing tour, hotel or any other product purchased with an equivalent product. In the event that such services are inferior (lower in category), it is the responsibility of Simpatico Tours Inc. to refund the difference in price between the products. While at destination, Simpatico Tours Inc. or Simpatico Tours Inc. local representative can decide, due to unforeseen reasons, to change, substitute or upgrade the product purchased with an equivalent product. If the clients refuse the equivalent or the upgrade offered to them there is no recourse on the clients behalf and the clients will then be responsible to assume payments requested from them as they make their own arrangements.

16. Responsibility: Simpatico Tours Inc. and their suppliers, agents, and affiliates are responsible only for arranging the tour services as offered in this brochure. Simpatico Tours Inc. is not responsible for any misprints or typographical errors in this brochure. Simpatico Tours Inc. and their suppliers and/or agents act only as agents for the passengers in regard to travel whether by railroad, motor coach, car, boat, aircraft, or any other conveyance, and assume no liability for any changes in contracts between airlines, loss, accident, injury, death, theft, incommodities, labour disputes, machinery difficulties, government restraints, weather conditions, quarantine, war, or any defects and/or misadventures or causes beyond our control. Responsibility of participating carriers is limited. The airlines concerned may not be held liable or responsible for any inconveniences, loss, damage or injury arising out of or in conjunction with the tour services described herein, other than the liability under the ticket and tariff provision for carriage by air supplied by those airlines.

17. Comments and Claims: If a problem arises while on holiday please verify directly with the hotel manager or contact our local representative. Contact your travel agent if no solutions were presented to you so that we can immediately rectify the problem to the best of our ability. Any claim against Simpatico Tours Inc. must be made by the passenger in writing and submitted to Simpatico Tours Inc. no later than 30 days after the termination of travel dates (of products purchased with Simpatico Tours Inc.). Please allow at least 8 weeks for processing and include any unused documents with correspondence. Please address all refunds to our customer service department. Claims or demands made after the 30 days may result as default and will not be addressed.

18. Applicable Law: The passenger(s) booking and paying for services provided in this brochure accepts and is bound to the terms and conditions, as printed by Simpatico Tours Inc. Simpatico Tours Inc. contractual obligation is to deliver the services for which the clients have booked and purchased. All claims and litigations are subject to Quebec Law. In the event of any legal action, proceedings will take place in a Quebec court of Law.

19. Travel Documents: The customer is responsible for all passports, visa entry, health and any other requirement or any other document required by law, regulations or order by the country or countries visited. All passengers travelling to Europe require a valid passport. Government, law officials or immigration can deny boarding to any consumer. These reasons are beyond the control of Simpatico Tours Inc. and no refunds will be granted for any unused product. If travel documents are lost, stolen, or misplaced no replacements or refunds will be granted.
